SPartner SP z o.o. is a company
under polish law, subsidiary fully owned by Aedex.
It was created in 2005 in the context of the European Union enlargement,
from 15 to 25 countries. New EU members then had to transpose into
their law the European directive on workers information.
Among these countries, Poland is the first destination for foreign
direct investments (wherever they come from) in the area of Central
and Eastern Europe countries, and it is the first addressee for French
companies international investments among all Central and Eastern
Europe countries.
Works councils only exist in state companies (their number keeps decreasing).
In addition to these structures, there is a representation of workers
at the level of the direction board in old state companies. A discussion
is currently going on about the implementation of works councils in
private companies, which should end with a compromise. It will be
the basis for a proposition of a law prepared both by the employers
and by the trade unions.
Several European directives have dealt with « the involvement
of workers in the company », specifically the 1994 one
on European Works Councils, or
the 2001 one on the European
Society.
The directive 2002/14 from March 11th 2002 strengthens this legal
framework by taking into account the national dimension by creating
a general framework related to workers information and consultation
in the European Community. It explains that « information
and consultation at the useful moment are a precondition to the
success of restructuring processes and to the adaptation of companies
to the new environment created by the globalisation of economy,
specifically through the development of labour organisation new
development methods. » |
